Mr. Benard regularly represents both private and public clients in wrongful termination, harassment, and discrimination claims in both federal and state courts, as well as in administrative proceedings before federal and state agencies. He provides sound counsel to clients regarding employee relations, employee contracts, and employee handbooks.

He also represents employers in matters related to the Family and Medical Leave Act, the Uniformed Services Employment and Re-employment Rights Act, the Americans with Disabilities Act, and the Fair Labor Standards Act, including administrative investigations into wage and hour complaints. Mr. Benard frequently conducts public and in-house seminars and workshops on various labor and employment related issues.

Additionally, Mr. Benard has extensive experience with intellectual property issues, natural resources and environmental disputes, regulatory matters and inverse condemnation. This includes litigation related to the Environmental Protection Act, the Endangered Species Act, and the Comprehensive Environmental Response, Compensation, and Liability Act; the Mine Safety and Health Administration Act, the Federal Oil and Gas Royalty Management Act, and the Uniform Trade Secrets Act; and related laws. He also represents retailers with regard to public access, accommodations, and compliance under the Americans with Disabilities Act.

Mr. Benard is admitted to practice in Utah and California, as well as being admitted to practice before the United States Supreme Court, the United States Court of Appeal for the Tenth Circuit, the United States District Court for the Central, Eastern and Southern Districts of California, and the United States District Court of Utah.

Mr. Benard currently serves as the Labor and Employment Practice Group leader. He is in his second term as an elected City Councilman for South Ogden City. Prior to joining the Salt Lake City office of Holland & Hart in May 2001, Mr. Benard practiced law in Southern California. Mr. Benard is fluent in Spanish. He is a volunteer speaker on transracial adoptions and related adoption issues for both private and governmental entities.
